Terms and Conditions of Sale
The following Terms and Conditions of Sale, together with the privacy policy, the delivery and shipping policy and the returns and refund policy, govern the offer and sale on the barkell.it website.
These Terms and Conditions of Sale are drawn up in compliance with the legislative provisions of the Italian Civil Code, the Legislative Decree. n. 70/2014 regarding information society services and electronic commerce, to the Consumer Code and which regulate the offer and sale of products through barkell.it.
The products marketed by barkell.it are sold directly by HASH di Zagaria Vincenzo with headquarters in Via Napoli 72, 76123 Andria (BT), VAT number 08009590723.
SCOPE OF APPLICATION
These Terms and Conditions of Sale apply to and govern all sales contracts concluded through barbell.it and may undergo changes, therefore each Customer is required to consult them before proceeding with each purchase and submitting the order.
HASH di Zagaria Vincenzo is never responsible for the supply of “HASH” branded products by any third parties present on barkell.it through links, banners or hyperlinks. The purchase of products on barbell.it is reserved exclusively for natural persons who act as consumers for purposes unrelated to any commercial and professional activity carried out.
CONCLUSION OF THE CONTRACT
These Terms and Conditions of Sale are an integral and essential part of the sales contract between HASH di Zagaria Vincenzo and the Customer. The electronic sending of the order by the Customer implies total knowledge and full acceptance of these Terms and Conditions of Sale, the Privacy Policy, the delivery and shipping information and the information on returns and refunds. If the Customer does not agree with one or more terms contained in these Terms and Conditions of Sale, please refrain from making purchases on barbell.it.
To proceed with the online purchase of one or more products, the Customer must first register on barshell.it, providing HASH di Zagaria Vincenzo, in compliance with the provisions on the protection of personal data, with all the data necessary to allow the latter to execute the orders submitted.
To conclude your purchase contract, the User must send your order following the procedure recalled on barbell.it. Sending the order electronically gives rise to the Customer's obligation to pay the indicated price.
To complete the purchase, the Customer is required to confirm payment of the price of the products placed in the cart. Orders that do not record the corresponding transaction are automatically canceled.
When the Customer places an order he will receive an e-mail containing confirmation of receipt of the order and a summary of the same: this communication will not however constitute automatic acceptance of the order.
HASH di Zagaria Vincenzo reserves the right to refuse orders that are incomplete and incorrect or from users with whom there is an ongoing dispute regarding the payment of a previous order.
In such cases the Customer will receive the specifically motivated refusal of the order by e-mail.
If the products presented on barkell.it are no longer available at the time of the last access to barkell.it or from the time the order was sent, HASH di Zagaria Vincenzo will be responsible for communicating to the Customer, within 5 days starting from the day following the day on which the order is sent, the unavailability of the product ordered. In the event of payment being made, HASH di Zagaria Vincenzo will refund the price without being liable for further compensation.
The order form contains a reference to these Terms and Conditions of Sale, the Privacy Policy, the information on delivery and shipping and the information on returns and refunds, as well as a summary of the essential characteristics of each product ordered and the relative price, the accepted means of payment and the delivery methods of the purchased products, the shipping costs, the conditions for exercising the right of withdrawal and the methods and times for returning the purchased products.
PRODUCT CHARACTERISTICS
The products offered for sale on barbell.it are men's clothing and accessories, present in the online catalog at the time of order.
The product catalog may be updated and modified periodically, therefore the permanence of a product among those available online is not guaranteed.
Each product is presented by a descriptive sheet where all the essential characteristics are reported; the images and colors of the products offered for sale may not correspond exactly to the real ones due to the settings of the computer systems used by the User for viewing barbell.it. The images of the products must, therefore, be considered indicative and without prejudice to normal tolerances of use.
SALES PRICES
All sales prices of the products indicated on barbell.it include VAT, if applicable due to the country of shipment of the products and any other tax that may be applicable to the sale.
Product prices may be subject to updates and changes. The Customer is required to ascertain the final sales price before submitting the relevant order.
PAYMENT METHODS
To pay for the products and related shipping and delivery costs, if applicable, the Customer may follow one of the methods indicated:
CREDIT/DEBIT AND PREPAID CARDS:
We accept all cards that have the Visa logo, MasterCard, rechargeable credit cards and Maestro and Visa Electron debit cards.
PAYPAL:
The most widespread payment system in the world, simple and secure. If you don't have a PayPal account yet, you can create one here or before completing the order.
Your PayPal account will be charged upon completion of the order.
CASH ON DELIVERY (Europe)
Payment by cash on delivery is expected upon delivery of the package by the courier. Only cash is accepted for this payment method. The mark costs €5.00.
DELIVERY METHOD
The products are delivered, via partner couriers, directly to the Customer at the shipping address specified in the order.
By filling in the personal data sheet in the registration procedure necessary to activate the process for the execution of this contract and further communications, the Customer authorizes barkell.it to communicate the personal data to the trusted couriers and/or shippers used for the delivery of the purchased products in order to allow the procedures necessary for their delivery.
HASH di Zagaria Vincenzo will do everything possible to process the order sent within 2 working days starting from the day following the day on which the Customer sent the order.
Delivery times include working days only and do not include holidays.
barbell.it allows you to request delivery of the products ordered to an address other than the Customer's own, provided that it is included in the Customer's country of residence indicated during login; in any case it is the Customer's responsibility to indicate all the references necessary for the successful delivery.
There is also the possibility of collecting the products purchased through barkell.it directly at the HASH store in Zagaria Vincenzo.
The costs and types of shipping provided may vary depending on the country and the shipping methods chosen by the Customer.
These expenses and any additional costs are the responsibility of the Customer. The relevant amount will be expressly and separately indicated in the order summary, before the Customer proceeds with the transmission of the same, as well as in the order confirmation email.
Both in Italy and abroad the delivery procedure provides that, if the customer is absent on the first attempt, the courier will make a new attempt on the following working day. If the courier, after having made 2 attempts, is unable to make the delivery, the HASH company of Zagaria Vincenzo will contact the customer informing him of the incident and trying to agree on a new delivery date. In this case, the customer is required to pay the costs for the release of the stock from the courier's warehouse (these costs will be communicated via email). In the event of failure to collect the package within 4 days, it will be returned to the HASH of Zagaria Vincenzo and in this case the order must be considered canceled pursuant to the art. 1456 of the Civil Code, with communication from HASH di Zagaria Vincenzo sent by e-mail to the Customer. The order must be placed directly from the website of the country in which it will be delivered. Orders placed on barkell.it from a country other than the destination, or to an address not accepted by the courier will be automatically cancelled.
USER OBLIGATIONS
It is strictly forbidden for minors to place an order on barkell.it.
The data entered during the purchase phase must be exclusively your real personal data and not that of third parties or fictitious data. HASH di Zagaria Vincenzo reserves the right to legally prosecute any violation and abuse, in the interest and protection of all consumers.
The Customer releases HASH di Zagaria Vincenzo from any liability deriving from the issuing of incorrect tax documents due to errors relating to the data provided by the Customer, being himself solely responsible for the correct insertion.
Upon receipt of the products, the Customer is required to verify their conformity in relation to the order. In particular, you must pay attention to the correspondence between the number of packages indicated on the carrier's letter and those delivered and to the integrity of the packaging.
Any anomalies (e.g. tampering, damage) must be specified in writing directly in the courier's transport document and the Customer must refuse the delivery.
At the same time, the Customer is required to report the fact to Customer Service by writing to info@barkell.it
If the Customer accepts delivery of tampered or damaged products, the legal guarantee of conformity of the products will be forfeited.
RESPONSIBILITY
barkell.it does not assume any responsibility for disservices attributable to force majeure such as, by way of example, health emergencies, accidents, explosions, fires, strikes, earthquakes and other events that prevent, in whole or in part, from executing the contract within the agreed times.
HASH di Zagaria Vincenzo will not be liable to any party or third party for damages, losses and costs suffered following failure to execute the contract for the causes mentioned above, the customer having the right only to a refund of the price paid.
Likewise, HASH di Zagaria Vincenzo is not responsible for any fraudulent or illicit use that may be made by third parties of credit cards, checks and other means of payment, when paying for the products. In fact, at no time during the purchase procedure is HASH by Zagaria Vincenzo able to know the Customer's credit card number which, by opening a protected connection, is transmitted directly to the banking service manager.
RIGHT OF WITHDRAWAL
The Customer can exercise the right of withdrawal and return the product received, without specifying the reason, in compliance with the terms and methods set out below.
The Customer who wishes to make a return must contact Customer Service via email at: info@barkell.it within 10 days of delivery of the package to explicitly express your desire to withdraw from the contract, indicating your name, order number and the item you wish to return.
The item or items that you intend to return must be sent to the sender within 7 days of the withdrawal.
The returned item must not have been worn, washed or altered in any way. The garments must be in perfect condition and the soles of the shoes must not show signs of wear of any kind. Items that demonstrate a loss of value cannot be fully refunded. The customer is responsible for the loss of value of the goods. Each item must be returned including all its packaging, labels and accessories with which it was delivered. All items must be returned with their original box which cannot be altered or damaged, or used as the only external packaging for shipping. The packaging, labels and everything that accompanies the item are considered parts of the product itself.
Returns must be sent back from the same country as the original destination of the order.
The above conditions are necessary for the return to be accepted.
The customer is held responsible for the conditions in which the products are returned. Any decrease in value resulting from manipulations other than those necessary to establish their nature, characteristics and functioning may make it impossible to remarket the products. In this case, the customer will be withheld a sum of money estimated based on the decrease in the value of the returned products. Among others, some product manipulations that can lead to a decrease in value are: damage to the packaging, removal of labels, signs of use and loss of packaging.
TERMS AND CONDITIONS FOR REFUND
The refund will be scheduled as soon as our employees have received and checked the returned goods. If the return corresponds to the suitability requirements specified above, barkell.it undertakes to refund the purchase, excluding the "cash on delivery" payment costs as this is a service provided directly by the courier. The refund will be made within 14 days of the arrival of the return at our barkell.it store, using the same payment method used by the Customer. In the event that the Customer has chosen Cash on Delivery as a payment method, the refund will be made via bank transfer.
Exceptions to reimbursement of shipping costs
Order and purchase of a quantity of items sufficient to reach the Free Shipping threshold (read Shipping Policy) and return of a quantity of items that effectively brings the value of the order below this threshold.
Return of orders whose amount is less than the minimum spend required for "free shipping".
Orders and/or products returned and purchased with promotional coupon codes of any kind and value.
Alternative Compensations
When authorizing the return, the Customer can choose one of the three compensation formulas below:
-Size replacement: You can request a size replacement for the same item, if available.
- Item replacement: The Customer will be sent confirmation of the return authorization containing a discount code (coupon) for the value of the returned items, which can be used to purchase a different item.
- Shopping voucher: The customer will be able to request, instead of a cash refund, a shopping voucher of the same value as the return to be used for a next purchase on the barkell.it website
HOW TO PREPARE THE SHIPMENT
- Contact Customer Service at info@barkell.it and communicate your desire to return the article/articles by indicating: n. Order, code or item description. We ask our customers to kindly inform us about the reasons for the return.
- Carefully package the package, possibly using the same packaging you received. Inadequate packaging could damage the goods and cause a loss of value. If using the same packaging as HASH, do not forget to remove the previously used return labels.
- Send the package back to: HASH by Zagaria Vincenzo Via Napoli 72, 76123 Andria (bt) , within 7 days of written authorization to the customer by the returns department.
These terms of use refer to the law in force and in particular to the Legislative Decree Legislative Decree 21/2014 which regulates the Consumer Code.

GUARANTEE OF CONFORMITY
Pursuant to the law, HASH di Zagaria Vincenzo has the obligation to deliver goods to the User that comply with the sales contract and is liable for any lack of conformity of the products existing at the time of delivery. For the purposes of the validity of the preceding guarantee, the Customer must report the lack of conformity to HASH di Zagaria Vincenzo within 30 days of discovery, under penalty of forfeiture, by contacting Customer Service info@barkell.it. The report must contain an accurate and complete description of the disputed faults and defects.
Customer Service will communicate to the Customer the instructions for returning the defective product which will take place at the expense of HASH di Zagaria Vincenzo.
The Customer will have the right to request the termination of the contract and the refund of the amount paid or, alternatively, the replacement of the product. In any case, defects of conformity resulting from damage due to accidental events or from the Customer's responsibility for use that does not conform to the intended use of the product are excluded from the legal guarantee.
APPLICABLE LAW
Any dispute relating to the application, execution, interpretation and violation of sales contracts stipulated through barbell.it is subject to Italian law. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
In any case, any rights attributed to the Consumer by mandatory provisions of law in force in the State of residence or domicile of the latter will be reserved.
CHANGES AND UPDATES
HASH di Zagaria Vincenzo reserves the right to modify barkell.it, the policies and these Terms and Conditions of Sale at any time to offer new products or services, or to comply with legal or regulatory provisions. The Customer who accesses barbell.it and places an order will adhere to the policies and Terms and Conditions of Sale in force from time to time at the time the order is placed, unless any changes have retroactive effect under applicable law. If one of the provisions herein is deemed invalid, void or inapplicable, this condition will not in any case affect the validity and effectiveness of the other provisions.
